Cannabis and Travel: Can You Fly with Weed or Cross State Lines?
## The Short Answer Transporting cannabis across state lines is federally illegal, regardless of the legal status in either state. Flying with cannabis on a commercial flight is federally illegal, even between two legal states. For adults 21 and older, the rule is simple: do not take cannabis across state lines, do not fly with it, and do not ship it through USPS or carriers. These rules are clear. ## Air Travel Cannabis, hemp-derived CBD, and related products are subject to TSA screening, which is federal: - **Cannabis.** Federally illegal. TSA screeners primarily look for threats to aviation, not drug possession, but anything they discover can be referred to local law enforcement. - **Hemp-derived CBD** (under 0.3 percent Delta-9 THC). Federally legal since the 2018 Farm Bill. TSA explicitly permits it. - **Medical marijuana.** Federally illegal despite any state medical card. TSA does not make state-medical exceptions. TSA guidance: if cannabis is discovered during screening, referral to local law enforcement depends on the airport and jurisdiction. Some airports (Los Angeles, for example) have formal non-prosecution policies for possession under state limits. Others enforce federal law through local authorities. ## Driving Between States Driving cannabis across state lines is federal interstate drug trafficking, even between two fully-legal states. There are no legal exceptions for adult-use or medical cardholders. Border patrols, state troopers, and federal agents all have authority to enforce. This matters particularly for: - **Commuters and travelers** in the northeast corridor (where adult-use states border each other). - **Vacation routes** through legal states. - **Moving between residences.** The rule: consume (legally) where you are; buy (legally) where you're going. Don't transport. ## Shipping USPS is a federal agency. Shipping cannabis through USPS is a federal crime. FedEx and UPS are private carriers subject to the same federal laws. No carrier legally ships cannabis across state lines. Hemp-derived products (CBD under 0.3 percent Delta-9 THC) are shippable through USPS and other carriers. ## International Travel Bringing cannabis into or out of the United States is a federal crime. Cannabis laws in destination countries vary significantly; some countries have severe penalties for possession. Research the destination's laws before traveling. ## What You Can Do Legally - Consume cannabis within a state where it's legal, following that state's rules. - Buy at a licensed dispensary in the state you're visiting (if you're 21+ and the state permits non-resident purchases, as most adult-use states do). - Consume what you bought before leaving the state. ## Where to Go Next Related reading: [is cannabis legal in my state](/blog/is-cannabis-legal-in-my-state-a-state-by-state-guide-to-marijuana-laws), [cannabis-friendly tourism](/blog/cannabis-friendly-tourism-top-destinations-and-what-to-know), and [federal cannabis laws explained](/blog/federal-cannabis-laws-explained-where-rescheduling-and-reform-stand). --- *This article is consumer education for adults 21+.
